Distance Sales Agreement

1. PARTIES AND FORMATION
This agreement is formed between the customer submitting a booking request for a dated tour/activity through https://sarigermetours.com and Sarigerme Tours.com SEY. ACEN. TAŞ. İNŞ. SAN. VE TİC. LTD. ŞTİ. (TÜRSAB No. 6421) when the agency confirms the request in writing. Submission of the online form alone is not final confirmation.
2. SUBJECT OF THE AGREEMENT
The subject is the supply of the tour/activity described in the written confirmation in accordance with its date, time, party size, pickup/meeting point, price, payment method, inclusions, exclusions and special conditions. The tour page, Pre-contract Information, written booking confirmation and the legal versions accepted by the customer form part of the agreement.
3. PRICE AND PAYMENT
The contract price is the price displayed before confirmation and stated in the written confirmation. Under the current flow, payment is cash on the tour day unless otherwise agreed in writing. No new mandatory charge is added later without the customer's express agreement. If a separate payment provider is used, payment status is final only upon verified provider confirmation.
4. CUSTOMER OBLIGATIONS
The customer must provide correct contact, passenger, relevant age/health and pickup/hotel information, be ready at the confirmed meeting/pickup time, and comply with safety rules and instructions of guides, captains, pilots and local authorities. The agency will make reasonable efforts to resolve operational issues but is not responsible for consequences caused by materially incorrect information supplied by the customer.
5. AGENCY OBLIGATIONS
The agency organises the confirmed service according to its essential characteristics and informs the customer of material changes or impossibility through available contact channels. Reasonable route/time changes may be made where required by safety or operations. Third-party services not promised or included in the confirmation are outside the contract.
6. RIGHT OF WITHDRAWAL
Under Turkish distance-contract rules, leisure services to be performed on a specific date or period are among the exceptions to the general withdrawal right. The general 14-day withdrawal right may therefore not apply to a confirmed dated tour/activity. An unconfirmed booking request may be withdrawn without charge.
7. CANCELLATION, CHANGES, NO-SHOW AND REFUNDS
After confirmation, customer-initiated cancellations/changes are handled under tour-specific conditions disclosed before confirmation. A non-recoverable supplier charge is taken into account only if disclosed to the customer in advance. Failure to attend the confirmed pickup/meeting point on time may be treated as a no-show. If the agency cannot provide the service or performance becomes impossible, the customer is informed and any amount collected in advance is refunded in accordance with applicable law, or an alternative may be offered with the customer's agreement.
8. FORCE MAJEURE AND SAFETY
In natural disasters, severe weather/sea conditions, fire, epidemic, strikes, authority decisions, road/port closures, security risks or comparable events outside reasonable control, safety takes priority. Where possible, an alternative date/route is offered; otherwise the treatment of any amount already collected is determined under applicable law and the extent of service actually provided or impossible to provide.

10. DISPUTES
Turkish law applies. Consumer rights to apply to competent Consumer Arbitration Committees and Consumer Courts under Law No. 6502 remain reserved. Nothing in this agreement restricts a jurisdiction or remedy granted to consumers by mandatory law.
